The subject of this agreement is the sale and performance, in accordance with Turkish Law No. 6502 on Consumer Protection and the Distance Contracts Regulation, of a subscription to the nixscale plan (Team or Business) and period (monthly or yearly) selected by the buyer on the checkout page for the selected organization.
3. Characteristics and price of the service
3.1. The selected plan, period and total price including VAT are shown on the checkout page; they form an integral part of this agreement and are stored with the buyer's payment record.
3.2. The plan belongs to the organization and applies to all of its networks. The limits included in each plan (number of networks, number of people, total devices across all networks) and its features are published in the pricing section of the website.
3.3. Prices include VAT. No fee is charged beyond the amount shown at checkout.
4. Payment
4.1. The fee is collected by credit card through the payment institution iyzico Ödeme Hizmetleri A.Ş., in advance at the start of each period. Card details are not stored by the seller.
4.2. Unless cancelled, the subscription renews automatically at the end of each period for the same period, and the fee in effect on the renewal date is charged to the buyer's card on file. The buyer accepts this automatic renewal on the checkout page.
4.3. The seller notifies price changes to the buyer's registered email address at least 30 days before they take effect. If the buyer does not accept the change, the buyer may cancel at the end of the current period.
4.4. An electronic invoice is issued for each charge using the billing details provided by the buyer and sent by email.
5. Performance
5.1. The service is digital and involves no physical delivery. Once payment is confirmed the buyer's organization and its networks move to the selected plan and the service is performed immediately.
5.2. The seller provides the service for the term of the agreement under the Terms of Service.
6. Right of withdrawal
6.1. Under Article 15(1)(ğ) of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for services whose performance began with the consumer's approval before the withdrawal period expired. By confirming payment the buyer requests immediate performance and acknowledges that no right of withdrawal exists.
6.2. Independently of section 6.1, the seller undertakes to refund the fee unconditionally if the buyer requests it within 14 days of the initial purchase or of any renewal. Refund conditions are set out on the Delivery and Refund Terms page.
7. Cancellation and termination
7.1. The buyer may cancel the subscription at any time by writing to [email protected]. Cancellation takes effect at the end of the current period; the service continues until then, no further fee is charged and no refund is made for the remaining period (section 6.2 is reserved).
7.2. At the end of the period the organization and its networks move to the free plan. Existing devices and members are not deleted; new enrolments beyond the free plan's limits are blocked.
7.3. If a renewal fee cannot be collected the seller notifies the buyer by email. If the fee is not collected within 7 days the organization and its networks are suspended; devices cannot connect and data is preserved. If the suspension exceeds 30 days the seller may terminate the agreement and delete the organization's networks together with their data.
7.4. The seller may terminate the agreement for cause if the buyer breaches the acceptable-use rules in the Terms of Service.

For buyers who are not consumers, the courts and enforcement offices of Istanbul have jurisdiction.
10. Entry into force
This agreement enters into force when the buyer confirms it on the checkout page and payment is completed. The confirmed version and the time of confirmation are stored with the buyer's payment record; the buyer may access this record in the panel or request it from the seller.
