Terms of Service

Last updated: September 14, 2026 · Version 1.2

This page is a translation; in case of conflict the Turkish version prevails.

These Terms of Service ("Terms") govern the relationship between BASE9 Bilişim Teknolojileri Ticaret A.Ş. ("nixscale", "we") and the natural or legal person using the nixscale service ("Customer", "you"). By signing up for or using the service you accept these Terms. If you accept on behalf of a company, you represent that you have the authority to bind it.

1. Definitions

  • Service: the managed WireGuard networking service we provide, including the nixscale web panel, the Control API and the isolated coordination server provisioned for each customer.
  • Organization: the account unit created for every customer that signs up. The plan, subscription, billing details and members belong to the Organization; an Organization may contain as many Networks as its plan allows.
  • Network: a customer network (tenant) belonging to an Organization, with its own coordination server and IP block.
  • Device: a computer, server, phone or similar endpoint enrolled in a Network.
  • Member: a user account that joined an Organization by invitation. Roles: owner, admin, member. Owners and admins manage all of the Organization's Networks; members only access the Networks they are assigned to.
  • Customer Data: data you provide while using the Service, or that the Service processes on your behalf (device names, IP addresses, policy definitions, member emails, audit records).
  • Plan: a free or paid service package and the limits attached to it (number of Networks, number of people, total devices across all of the Organization's Networks, features). The plan belongs to the Organization and applies to all of its Networks.

2. Account, organization and network

2.1. Signing up requires a verified email address. You are responsible for keeping your account details accurate and current.

2.2. You are responsible for all activity under your account. Notify us immediately if you become aware of unauthorised use of your credentials.

2.3. An Organization is created for every customer that signs up. The Organization's owners and admins may invite members to the Organization, assign roles, remove members and assign members to Networks. An Organization must always have at least one owner; the founding account cannot be removed from it.

2.4. When a member is removed from or leaves an Organization, access from their personal devices in all of the Organization's Networks is revoked; when removed from a single Network, in that Network. Devices labelled as machines are considered the Network's property and remain in it.

3. Acceptable use

You may use the Service only for lawful purposes. The following are prohibited:

  • accessing, or using the Service to access, systems you are not authorised to access;
  • distributing malware, unsolicited bulk messages or denial-of-service attacks;
  • overloading the Service in a way that harms our infrastructure or other customers;
  • attempting to bypass the Service's security or access controls;
  • reselling or sublicensing the Service to third parties without permission;
  • infringing the intellectual property, privacy or other rights of third parties.

If you breach these rules we may suspend or close your account, Organization or Networks without prior notice.

4. Plans, fees and payment

4.1. Current prices and limits of paid plans are published in the pricing section of our website. Published prices include VAT.

4.2. Paid subscriptions are purchased for monthly or yearly periods and charged in advance at the start of each period. Payments are collected by credit card through the payment institution iyzico Ödeme Hizmetleri A.Ş.; we do not store your card details.

4.3. Automatic renewal. Unless cancelled before the end of the period, the subscription renews automatically for the same period at the price in effect at that time, and the fee is charged to the card on file.

4.4. Price changes. We notify you of price changes by email at least 30 days before they take effect. A change applies from the first renewal after the notice. If you do not accept the change you may cancel at the end of the current period.

4.5. Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current period; paid features remain available until then. At the end of the period your Organization and all of its Networks move to the free plan; existing devices and members are not deleted, but new enrolments beyond the free plan's limits are blocked.

4.6. Refunds. If you request it within 14 days of the initial purchase or of any renewal, we refund the fee unconditionally. Details are on the Delivery and Refund Terms page.

4.7. Failed payment. If a renewal payment cannot be collected we notify you by email. If payment is not received within 7 days your Organization and all of its Networks are suspended: devices cannot connect, your data is preserved. If the suspension exceeds 30 days the Organization's Networks and their data are deleted.

4.8. Invoices. We issue an electronic invoice for every payment using the billing details you provided at checkout.

4.9. The free plan is intended for trial and development; it has limited capacity and we may suspend free Networks that have been unused for 60 days.

5. Customer data and privacy

5.1. Customer Data belongs to you. You grant us only the limited right to use it as needed to provide, maintain and improve the Service.

5.2. Network traffic between your devices is end-to-end encrypted and does not cross our infrastructure; we cannot see its contents. Relay servers used when a direct connection cannot be established forward encrypted packets only.

5.3. Details on the processing of personal data are in the Privacy Policy and the KVKK Notice.

5.4. We do not use Customer Data to train artificial-intelligence models.

6. Service level and support

6.1. The Service is provided "as is"; we do not warrant that it will be uninterrupted or error-free. We announce planned maintenance in advance where possible.

6.2. Any service-level commitments for paid plans are stated on the pricing page.

6.3. Support channels are listed on the Contact page.

7. Intellectual property

The Service, its software and trademarks belong to us or our licensors. Open-source components used underneath (WireGuard, headscale, Tailscale clients) are subject to their own licences. These Terms grant you no rights other than to use the Service.

8. Term and termination

8.1. These Terms remain in effect for as long as your account is open.

8.2. You may close your account, Organization and Networks at any time. Fees already paid are not refunded on closure, subject to the refund right in section 4.6.

8.3. We may suspend or terminate the Service if you breach these Terms or where required by law. We give prior notice where possible.

8.4. After termination or deletion, Customer Data is deleted following a 30-day retention period, except where legal retention obligations apply.

9. Limitation of liability

9.1. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or punitive damages, including loss of profit, loss of data or business interruption.

9.2. Our total liability under these Terms is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim.

9.3. These limitations do not apply to liability arising from wilful misconduct or gross negligence, or where liability cannot be limited by law.

10. Changes

We may update these Terms. We announce material changes by email or in the panel at least 30 days before they take effect. Continuing to use the Service after a change means you accept the new Terms.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Istanbul have jurisdiction over disputes. Customers acting as consumers retain the right to apply to consumer arbitration committees and consumer courts.

12. Miscellaneous

These Terms, together with the Privacy Policy, the Distance Sales Agreement and the Delivery and Refund Terms, constitute the entire agreement between the parties. If a provision is held invalid, the others remain in effect. This English text is a translation provided for convenience; in case of conflict the Turkish version prevails.
